1. Eligibility for Service Use

Our services are available to individuals who are at least 16 years of age.

2. Prohibited Activities

Users are strictly prohibited from engaging in the following activities while utilizing the services:

• Harassing and abusing others through threats, stalking, or spam.
• Contributing to discrimination, harassment, or harm against any individual or group, including the dissemination of hate and bigotry based on racism, ethnophobia, antisemitism, sexism, homophobia, or any other forms of discriminatory behavior.
• Engaging in the indiscriminate use of server resources: content occupying significant storage space may be removed at any time, without prior warning.
• Contributing to the abuse of others by distributing material that involves violence or assault against persons or animals or promotes self-harm.
• Impersonating or portraying another person in a confusing or deceptive manner.
• Utilizing our services for the distribution of spam, viruses, adult or otherwise obscene imagery or any other harmful content.
• Doxxing, the publication of other people's personal data, is strictly prohibited.
• Misuse of services by distributing viruses or malware, engaging in a denial of service attack, or attempting to gain unauthorized access to any computer system.
• Engaging in activities not permitted by national or international law. Please read more about our jurisdiction and hosting infrastructure in section 6 as well as the legal responsibilities in section 5.
• Uploading or publicly sharing copyrighted material or any other content that infringes upon intellectual property rights.

3. Commercial Use

Users are expressly prohibited from engaging in commercial activities or using the services provided by 1998 for the purpose of generating revenue without prior written consent from an administrator. Commercial activities include, but are not limited to, the sale of goods or services, advertising, or any other activity conducted with the primary intention of monetary gain.

Any user seeking to use the services for commercial purposes must request and obtain explicit permission from an administrator. Requests can be submitted through e-mail. 1998 reserves the right to grant or deny such requests at its discretion.

4. Ownership and Accountability for Content

We do not assume responsibility for any user-generated content published on our services to the extent permitted by law. Users are accountable for their utilization of the services, the content they provide, and any consequences arising from such use. However, in order to uphold our operational integrity, we retain the right to remove any content found in violation of applicable laws or this document.

5. Legal Responsibilities

We are not liable for the content you generate (up to the extent permitted by law) nor do we guarantee the protection of your privacy. Users are encouraged to leverage existing tools to assert and safeguard their rights.

6. Jurisdiction and Hosting Infrastructure

Our services are primarily hosted in Poland, Germany and the United States, rendering them subject to the laws of these jurisdictions.

You agree to comply with the laws of the jurisdiction in which you reside, the laws of Poland, Germany and the United States, and international law.

Please be aware that 1998 operates dynamically, and our hosting locations may undergo changes periodically. These changes may not be immediately reflected in this document during transition periods.

7. Service Termination

1998 reserves the right to terminate your service at any time, though such decisions are made judiciously. Termination is typically instigated if a user engages in one or more prohibited activities outlined in our terms.

8. No Warranty

You acknowledge and agree that 1998 primarily provides internet-based services. Accordingly, services are offered "as is", subject to availability and without liability to you. While we aim to uphold user satisfaction, we cannot provide a warranty regarding the reliability, accessibility, security, or quality of our services. You agree that the utilization of our services is at your sole and exclusive risk.

9. Changes to These Terms

We retain the right to modify these conditions at any time. Prioritizing transparency, we strive to promptly notify users of any notable changes. However, given our practice of avoiding the collection of email addresses or similar contact information, users realistically receive notifications about changes from the main page.
